Mac Law PLLC works with condominium and homeowners’ associations on a variety of legal issues including the collection of delinquent accounts, preparation and interpretation of governing documents, enforcement and interpretation of covenants and restrictions, pursuit of construction defect and warranty claims, lien issues, and the negotiation of contracts for services.

Landlord and Tenant Law

Mac Law PLLC represents both landlords and tenants in commercial and residential property matters.  Property leases in Florida are governed by Chapter 83 of the Florida Statutes which imposes specific responsibilities on both landlords and tenants.  Failure to strictly comply with the requirements of Chapter 83 can cost you time and money.  We can help you navigate this highly technical area of law to achieve your objectives in a timely and cost efficient manner.

Commercial and Residential Evictions

Many landlord and tenant relationships quickly turn hostile.  We can help you evict a commercial or residential tenant in a professional, cost-efficient manner, and recover the unpaid rent you are owed.  We will advise on how to proceed with the eviction, draft the notices required by law, and pursue the eviction in court.

If you are a residential or commercial tenant that has been served with an eviction, we will help you fight it.  There are legitimate legal defenses to some evictions, particularly commercial evictions, but usually defending an eviction consists of negotiating with the landlord to find a mutually agreed upon move-out date and settling the case before a Judgment for Eviction is entered.  If you have a Judgment for Eviction on your record, it can be very difficult to lease property in the future.

Commercial and Residential Leases

Mac Law PLLC will draft, negotiate, or review your commercial or residential lease and advise you of your rights and responsibilities under the lease.  Precise drafting of leases is imperative to ensuring you avoid costly litigation if there is a dispute.

Security Deposits, Unpaid Rent, and Damages

Mac Law PLLC represents both landlords and tenants in unpaid rent and security deposit disputes.  Very specific procedures must be followed for a landlord to make a claim against a security deposit or the landlord risks forfeiting his right to claim some or all of the deposit.

We also represent both landlords and tenants in disputes over damages to the property.  If you are a landlord, we can help you recover compensation for damages a tenant caused to your property.  If you are a tenant, and a landlord is unfairly accusing you of damaging his property, we can help you resolve this dispute and defend your rights in court if necessary.

Employment and Labor Law

Mac Law PLLC represents businesses in drafting and negotiating employment agreements, crafting employment policies which reduce potential liability, enforcing noncompete agreements, and defending against unpaid wage and overtime claims.

We also represent employees in advising them of their rights, and when necessary, in bringing suit against former employers who withheld wages, improperly refused to pay overtime, failed to meet minimum wage requirements, or breached an employment or severance agreement.

Unpaid Wage and Overtime Claims

The Fair Labor Standards Act (FLSA) places specific requirements on the employment practices of businesses.  The FLSA allows for the recovery of attorney’s fees for an employee prevailing in litigation, as well as liquidated damages of twice the amount of unpaid wages or overtime.  The act is a huge source of liability for companies that are not proactive in avoiding FLSA litigation, and can be a source of large cash settlements for employees who were illegally denied wages or overtime.  Whether you are an employer defending against a lawsuit, or an employee bringing a claim for unpaid wages, Mac Law PLLC will vigorously represent your interests.

Employment Agreements, Noncompete Agreements, Severance Agreements

Employment agreements, nondisclosure agreements, noncompete agreements, and severance agreements are essential for reducing the liability and protecting the competitive advantage of a business.  Mac Law PLLC can draft, negotiate, and review your employee agreements to ensure that you are protected.

If you are an employee being asked to sign one of these agreements, we can advise you of your rights and responsibilities under the agreement, as well as consequences of breaching the agreement.

Employee Policies
